Version 2026-09-20-v3. Terms for the Creacon platform pilot. These terms will be reviewed before paid services launch.
These Terms and Conditions govern use of Creacon (creaconglobal.com), a three-sided creator-marketing platform connecting Brands, Creators, and Agencies across the MENA region.
1. Definitions and Platform Description
Creacon ("the Platform," "we," "us") is a three-sided creator-marketing platform operated for the Egypt, UAE, and KSA markets, connecting three categories of users:
• Brand – an entity that creates and funds marketing campaigns on the Platform.
• Creator – an individual or entity that produces user-generated content (UGC) and influencer content for Brand campaigns.
• Agency – an entity that manages campaigns and creator relationships on behalf of one or more Brands, with access to campaign data according to the permissions granted for each workspace.
Campaign Assets means any content, including but not limited to videos, images, audio, captions, and derivative edits, submitted, uploaded, or produced by a Creator or Agency through the Platform in connection with a Brand campaign.
User means any Brand, Creator, or Agency registered on the Platform.
2. Accounts and Eligibility
2.1 Users must register an account and provide accurate, current information (legal name or business name, contact details, and, where applicable, tax/commercial registration).
2.2 Individual Creators must be at least 18 years old, or the age of majority in their jurisdiction, to register independently.
2.3 Each User is responsible for maintaining the confidentiality of their login credentials and for all activity under their account.
2.4 Creacon may verify, suspend, or reject any account at its discretion, including where information provided is false, incomplete, or where a User violates these Terms.
3. Campaigns, Content Submission, and Fees
3.1 Brands create campaigns specifying deliverables, required actions, budget, and timelines. Creators and Agencies apply to or are matched with campaigns via the Platform.
3.2 Creators submit Campaign Assets through the Platform for Brand review and approval per the campaign brief.
3.3 Pay-on-performance. Unless a campaign states otherwise, Creators are paid only upon fulfillment of the required actions specified in the campaign brief (e.g., posting, minimum reach, engagement thresholds), and the parties must follow the payment timeline stated in their campaign agreement. During the pilot, Creacon records payments but does not process, hold, guarantee, or release funds.
3.4 When paid services are activated, Creacon may charge disclosed platform and subscription fees to Brands, Creators, and/or Agencies, as disclosed at the time of purchase or campaign creation. Fees are non-refundable except as required by law or expressly stated in a campaign's terms.
3.5 Agencies acting on behalf of Brands are responsible for ensuring they have authority to bind the Brand to campaign terms entered through the Platform.
4. Content Ownership and License
4.1 Ownership. As between Creacon and the Creator, the Creator retains ownership of the original Campaign Assets they create, subject to the licenses granted below and to any separate agreement between the Creator and a Brand.
4.2 License to Brand. By submitting Campaign Assets to a campaign, the Creator grants the sponsoring Brand a non-exclusive, worldwide, royalty-free license to use, reproduce, and publish those Campaign Assets for the purposes and duration stated in the campaign brief.
4.3 License to Creacon, advertising and platform use. When separately authorizing promotional use, the Creator and, where applicable, the Agency grant Creacon a non-exclusive, worldwide, royalty-free, sub-licensable license to use, reproduce, adapt, and publish those Campaign Assets for Creacon's own advertising, marketing, and promotional purposes, including on Creacon's website, social media, pitch materials, and paid advertising, with attribution to the Creator and/or Brand where reasonably practicable. This license includes company logos and campaign-related likenesses only to the extent the User has authority to license them. Confidential data, tax documents, licensed research, and private messages are excluded. The license survives campaign completion, subject to opt-out and applicable law, but does not transfer ownership.
4.4 A Creator or Brand that does not want specific Campaign Assets used for Creacon's own advertising may opt out for those assets by written notice to creaconglobal@gmail.com identifying the assets. Creacon will stop future controlled promotional uses and make reasonable efforts to remove ongoing uses under its control. An “internal use only” control is not currently available.
4.5 Users represent that they own or hold all necessary rights (including any third-party rights, likeness, and music clearances) in the Campaign Assets they submit, and that use of those assets as permitted under this Section 4 will not infringe any third party's rights.
5. User Conduct and Content Standards
5.1 Users agree not to: (a) submit false, misleading, or fraudulent campaign data or performance metrics; (b) infringe any third party's intellectual property, privacy, or publicity rights; (c) post unlawful, defamatory, hateful, or sexually explicit content; (d) attempt to circumvent the Platform to pay or be paid outside its fee structure for a campaign sourced through Creacon; or (e) misuse another User's privileged data (e.g., an Agency sharing Brand-only campaign data with unauthorized third parties).
5.2 Users must not use threats, harassment, knowingly false allegations, or coordinated audience abuse to coerce another party. This does not restrict truthful reviews, lawful criticism, regulatory complaints, or legal remedies.
5.3 Creacon may remove Campaign Assets or suspend accounts that violate this Section, and may flag associated payment records for investigation. The pilot cannot withhold funds it does not hold. Any future payment restriction must follow the applicable provider agreement and law.
6. Disclaimers, Liability, and Indemnification
Nothing in this section excludes rights, remedies, or liability that cannot lawfully be excluded.
6.1 The Platform is provided "as is" and "as available." Creacon does not guarantee campaign outcomes, creator performance, or uninterrupted platform availability.
6.2 To the maximum extent permitted by law, Creacon's aggregate liability to any User arising from use of the Platform is limited to the fees paid by that User to Creacon in the 3 months preceding the claim.
6.3 Creacon is not liable for indirect, incidental, or consequential damages, including lost profits or lost data.
6.4 Each User agrees to indemnify and hold Creacon harmless from claims arising from that User's Campaign Assets, breach of these Terms, or violation of applicable law.
7. Term, Termination, and General Provisions
7.1 These Terms apply from account registration until the account is closed by the User or terminated by Creacon.
7.2 Creacon may terminate or suspend any account for breach of these Terms, with or without notice, at its discretion.
7.3 Sections 4 (Content Ownership and License), 6 (Disclaimers and Liability), and 7.4–7.6 survive termination.
7.4 Governing law. These Terms are governed by the laws of Egypt, subject to mandatory rights and laws that cannot be excluded, without regard to conflict-of-law principles.
7.5 Creacon may update these Terms and notify Users of material changes. Fresh acceptance will be requested where required by applicable law.
7.6 If any provision is held unenforceable, the remaining provisions remain in full effect.
